Being present in court can also aid recovery following the loss of a loved one.<\/li>\r\n<li>In certain circumstances, the Program will attenuate, if not eliminate, the financial impact and other repercussions for loved ones attending legal proceedings.<\/li>\r\n<\/ul>\r\n<p>[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;What are the objectives of the Program?&#8221; tab_id=&#8221;1547604277127-1efec6c7-786a&#8221;][vc_column_text]<\/p>\r\n<ul>\r\n<li>To recognize the need of those close to the deceased victim to be present at legal proceedings<\/li>\r\n<li>To make it easier for those close to the deceased victim of a criminal act to attend the legal proceedings<\/li>\r\n<li>To lessen the financial burden caused by expenses incurred by a victim\u2019s loved ones in order to be present at legal proceedings.<\/li>\r\n<\/ul>\r\n<p>[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;What are the underlying values of the Program?&#8221; tab_id=&#8221;1547604305950-ed0e3283-35e8&#8243;][vc_column_text]<\/p>\r\n<p>The Program promotes the values of compassion, consideration, equity, understanding, respect, professionalism and a spirit of collaboration.<\/p>\r\n<p>[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;Do similar initiatives exist in other provinces?&#8221; tab_id=&#8221;1547604340734-298fb1a3-062e&#8221;][vc_column_text]<\/p>\r\n<p>Yes, the provinces of New Brunswick, Ontario, Manitoba and British Columbia have all introduced similar measures.<\/p>\r\n<p>[\/vc_column_text][\/vc_tta_section][\/vc_tta_accordion][\/vc_column][\/vc_row][vc_row][vc_column]<div class=\"grve-element grve-hr \" style=\"padding-bottom: 4%;\"><div class=\"grve-line-divider\"><\/div><\/div>[vc_column_text]<\/p>\r\n<h2>How the Program works<\/h2>\r\n<p>[\/vc_column_text][vc_tta_accordion active_section=&#8221;1&#8243; collapsible_all=&#8221;true&#8221;][vc_tta_section title=&#8221;What expenses are reimbursed by the Program?&#8221; tab_id=&#8221;1547604123044-10b89302-b6c4&#8243;][vc_column_text]<\/p>\r\n<p>Expenses related to travel, meals, accommodation and parking are eligible for reimbursement under the Program. Details regarding expense reimbursement are available under the <a href=\"https:\/\/www.programmeproches.ca\/en\/reimbursement-amounts\/\">Reimbursement amounts<\/a> tab.<\/p>\r\n<p>[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;Does the Program offer compensation for loss of income?&#8221; tab_id=&#8221;1547603444968-a2fd93c0-3d2b&#8221;][vc_column_text]<\/p>\r\n<p>No.<\/p>\r\n<p>[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;Is the Program limited to cases of homicide?&#8221; tab_id=&#8221;1547603445025-a95a2544-c5e7&#8243;][vc_column_text]<\/p>\r\n<p>No, eligibility under the Program is not limited to victims of homicide. Included are all criminal acts causing death: criminal negligence, impaired driving, dangerous driving, etc.<\/p>\r\n<p>[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;Is it possible to extend the reimbursement of expenses to the family and close friends of victims of other serious crimes that did not result in death?&#8221; tab_id=&#8221;1547603445080-3504e6cb-0526&#8243;][vc_column_text]<\/p>\r\n<p>Unfortunately, no. Although Program partners are sensitive to the many repercussions of any criminal act on victims or witnesses and their loved ones, the financial capacity of the Program does not allow it to be extended beyond those close to deceased victims.<\/p>\r\n<p>[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;Is there a minimum distance that a family member or close friend must travel to attend legal proceedings in order to have their expenses reimbursed?&#8221; tab_id=&#8221;1547603445132-fd19e842-0a7a&#8221;][vc_column_text]<\/p>\r\n<p>No, there is no minimum distance requirement.<\/p>\r\n<p>[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;Are child care expenses reimbursed?&#8221; tab_id=&#8221;1547603445190-6243f979-9654&#8243;][vc_column_text]<\/p>\r\n<p>No.<\/p>\r\n<p>[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;For which steps in the judicial process is it possible to request reimbursement of expenses?&#8221; tab_id=&#8221;1547603445244-838633b1-7069&#8243;][vc_column_text]<\/p>\r\n<p>Reimbursement is offered at every stage in the criminal justice process. Those who were close to the victim are free to choose which proceedings they wish to attend.<\/p>\r\n<p>[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;If the court decision is appealed or a new trial is scheduled, will the eligible reimbursement amounts be increased?&#8221; tab_id=&#8221;1547603445306-ee00c2ae-8f0c&#8221;][vc_column_text]<\/p>\r\n<p>Expenses reimbursed in connection with appeal proceedings are included in the initial $2,000 maximum. In the event of a new trial, however, additional amounts will be made available.<\/p>\r\n<p>[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;What happens if a family member or close friend of the victim is summoned to appear in court by the Director of Criminal and Penal Prosecutions?&#8221; tab_id=&#8221;1547603445361-28c5e433-6b7c&#8221;][vc_column_text]<\/p>\r\n<p>If a family member or close friend is summoned to appear in court, the expenses incurred by that person on the day of the hearing will be paid by the Director of Criminal and Penal Prosecutions.<\/p>\r\n<p>A family member or close friend may not receive other compensation forms for expenses they have already claimed under the Program.<\/p>\r\n<p>[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;Who may complete an application form in order to be considered as an applicant by the Program?&#8221; tab_id=&#8221;1547603445418-d26cf91a-105d&#8221;][vc_column_text]<\/p>\r\n<p>Any family member or close friend of a person who died as the result of a criminal act may submit a request. \u201cFamily and close friends\u201d include any person related to the deceased person by birth, by marriage or by some other very close relationship with the deceased person (such as a close friend or other significant person).<\/p>\r\n<p>A maximum of two people will be accepted as applicants.<\/p>\r\n<p>[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;What will determine which applicants are eligible for reimbursements through the Program if more than two requests are submitted?&#8221; tab_id=&#8221;1547603445480-1b397f2d-c69b&#8221;][vc_column_text]<\/p>\r\n<p>Priority will be given to the immediate family, in the following order:<\/p>\r\n<ul>\r\n<li>spouse of the deceased victims<\/li>\r\n<li>child of the deceased victim<\/li>\r\n<li>father and mother of the deceased victim<\/li>\r\n<li>brother and sister of the deceased victim<\/li>\r\n<li>grandfather and grandmother of the deceased victim.<\/li>\r\n<\/ul>\r\n<p>[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;Do reimbursed amounts cover only the expenses of the two accepted applicants?&#8221; tab_id=&#8221;1547603445543-ee85fd97-74d9&#8243;][vc_column_text]<\/p>\r\n<p>No, each applicant may request reimbursement for themselves and a companion for each day of legal proceedings (not necessarily the same companion every day). It is important to note, however, that amounts reimbursed to companions will be deducted from the applicant\u2019s $2,000 maximum.<\/p>\r\n<p>[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;How are the amounts reimbursed by the Program divided between the two applicants?&#8221; tab_id=&#8221;1547603445606-c05fb034-7341&#8243;][vc_column_text]<\/p>\r\n<p>Each of the two applicants may claim expenses for up to a total of $2,000. This amount is applied to eligible expenses incurred by the applicants and their companion(s), as applicable.<\/p>\r\n<p>[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;How are expenses reimbursed?&#8221; tab_id=&#8221;1547603445672-b2328957-ce23&#8243;][vc_column_text]<\/p>\r\n<p>The Program reimburses eligible expenses in the form of cheque made payable to the applicant or directly to the companion on presentation of a reimbursement form and receipt of supporting documents (receipts, bills, etc.).<\/p>\r\n<p>All reimbursement forms completed by a companion must be signed by the recognized applicant on file.<\/p>\r\n<p>[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;Does the Program apply to all situations in Quebec?&#8221; tab_id=&#8221;1547603445737-26fc76bc-5aa1&#8243;][vc_column_text]<\/p>\r\n<p>Yes, the Program is intended for all family members and close friends of a person who died as a result of a criminal act that was committed in Quebec.<\/p>\r\n<p>[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;Is the Program restricted to residents of Quebec?&#8221; tab_id=&#8221;1547603445803-fc659433-826f&#8221;][vc_column_text]<\/p>\r\n<p>No, you do not have to reside in Quebec in order to submit an application and be reimbursed.<\/p>\r\n<p>[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;Do applicants have to be using the services of a CAVAC (Crime Victims Assistance Centre) in order to be eligible for the Program?&#8221; tab_id=&#8221;1547603445872-7b6a4509-3740&#8243;][vc_column_text]<\/p>\r\n<p>No, but it is strongly recommended that anyone who has been affected by the death of a loved one as the result of a criminal act seek psychosocial support. Several organizations offer this kind of support: the <a href=\"http:\/\/www.cavac.qc.ca\/\" target=\"_blank\" rel=\"noopener nofollow\">CAVAC network<\/a>, the <a href=\"http:\/\/afpad.ca\/\" target=\"_blank\" rel=\"noopener nofollow\">AFPAD<\/a> (association of families of homicide victims and missing persons), <a href=\"http:\/\/madd.ca\/pages\/?lang=en\" target=\"_blank\" rel=\"noopener nofollow\">MADD<\/a> (Mothers Against Drunk Driving), and various professionals such as psychologists and social workers.<\/p>\r\n<p>[\/vc_column_text][\/vc_tta_section][vc_tta_section title=&#8221;Why is there a need for a pilot phase?&#8221; tab_id=&#8221;1547603949498-e974bcc9-a71e&#8221;][vc_column_text]<\/p>\r\n<p>The pilot phase will allow us to evaluate and revise the Program as needed in order to effectively meet the needs of victims\u2019 loved ones.
