{"id":978,"date":"2019-01-24T14:59:39","date_gmt":"2019-01-24T18:59:39","guid":{"rendered":"https:\/\/www.programmeproches.ca\/?page_id=978"},"modified":"2019-01-24T22:04:45","modified_gmt":"2019-01-25T02:04:45","slug":"the-judicial-process-in-criminal-cases","status":"publish","type":"page","link":"https:\/\/www.programmeproches.ca\/en\/resources\/the-judicial-process-in-criminal-cases\/","title":{"rendered":"The judicial process in criminal cases"},"content":{"rendered":"<h1>The judicial process in criminal cases<\/h1>\n<p><em>This section is based on the Justice en Action brochure prepared by the Capitale-Nationale and Chaudi\u00e8re-Appalaches CAVAC \u2013 Crime Victims Assistance Centre.<\/em><\/p>\n<hr \/>\n<h3>LODGING A COMPLAINT<\/h3>\n<p>Recording of the declaration.<\/p>\n<hr \/>\n<h3>EVALUATION OF THE CASE<\/h3>\n<p>The prosecutor authorizes or refuses to accept the complaint.<\/p>\n<ul>\n<li><em>A lack of evidence doesn\u2019t mean that you are not believed!<\/em><\/li>\n<\/ul>\n<hr \/>\n<h3>LAYING THE CHARGES<\/h3>\n<p>The prosecutor determines the accusations to be brought before the court.<\/p>\n<hr \/>\n<h3>FIRST APPEARANCE<\/h3>\n<p>The accused is informed of the charge or the charges held against him.<\/p>\n<ul>\n<li><em>It is the first time when the accused must appear before a judge.<\/em><em>\u00a0<\/em><\/li>\n<\/ul>\n<ul>\n<li><em>At any time, the accused can plead guilty to the accusations.
